Replicant v2 Rip-Off? How similar do these two look?

I'm just now in the process of updating my site to Repilcant v2 Joomla 1.5. To my utter shock and surprise I see that Style One of the new version looks amazingly similar to my original background art and color theme of the first version Replicant. I created the original background graphics to set my site apart from others. I actually like Replicant v2 Style One as it is an updated version of my original design. The problem is my site will no longer showcase my original artwork/design. I guess its back to the drawing board for me. I think I'm done with Joomla and RocketTheme.
What do you think? Is this a shameless rip-off of an original design? Am I overacting? Should I be flattered?
