Someone ripped off my work with RT template

Ok, I'm so totally annoyed right now
I built a draft website for a client using Hive Mind. He is a local wedding photographer. The guy was young and starting out so I did him a cheap job. But after he messed me around and insisting upon design and software that was silly and insisted upon 500k images sizes in galleries of 250 pics in a flash program (which I told him wouldn't work), I got sick of working for him and told him to go elsewhere.
Now what do i see, a poor rip off (looks like they used some kind of screen capture) of my work templated over a different cms.

The site is a complete rip off. Do i or Rockettheme have any legal or copyright laws to stop him. I've already contacted him and told him to remove the site or face a lawsuit but the guy is such a slime ball I would not be surprised if he leaves it up and tries to call my bluff.

This is his site he ripped off: yoramconradt.com.auttt/ (remove the ttt - i don't want to give him any extra inbound links for goggle)
As you can see, he's used the hivemind template (butchered some graphics and layouts) and placed it over a different cms.
Probably done enough to escape copyright I guess, it just stinks.
