Has anyone from the "opposing" team actually consulted some "proper" legal advise in which a substantial opposing view to that of OSM's legal advise?

      Just a thought :)

Lots have, and the consensus is 'not a leg to stand on' however, going to court is an expensive process, and few of the extension companies earn enough to survive a protracted legal battle with the FSF.

Ideas of a warchest have been put forward, a preemptive suit against osm has also been suggested, but all of these really achieve nothing.

Plus the GPL has never really been challenged in court. If Joomla/OSM was to take anyone, or anyone was to take Joomla/OSM to court and challenge the GPL directly, whatever the outcome it would be disastrous.

OSM/Joomla win = The Viral nature gets a full on legal go ahead and you can watch any non GPL software projects everywhere start avoiding GPL projects like the plague (which it will have become) for fear of being sued just because they 'had contact' with GPL code.

3PDs win = The GPL gets thrown out as unenforcable, the GPL community will then have no protection for real derivative works and GPL projects will very quickly find (even more than now) Copycat proprietary works popping up.

The only 'safe' area to challenge is whether an extension is derivative or not. This is then a personal issue for each developer as different extensions have different amounts of contact.

      @Joseph
I feel exactly the same way. :'(

I don't think these are contradictory.... we don't intend to litigate, we don't expect to litigate, we expect folks to comply voluntarily. We've never said joomla/OSM will actively go after violaters. But, here's the important part, if we explicitly state in paper or electronic form, that we will NEVER go after people, then that's the same as saying, it's ok to break the license. It's a subtle difference, but it speaks magnitudes I think..

Thanks to this thread for getting me caught up with what is going on with Joomla and GPL. It'll be interesting to see what happens from here on.

      Templates for Mambo?

This is just not going to happen. However, let me take this opportunity to again put in a request for WP and/or Drupal themes. :)

Why not? It make good business sense to me and it requires only slight changes to Joomla templates to work in Mambo.

Unfortunately/Fortunately, not all business decisions are made based purely on the commercial viability of the idea. In this case, it would probably not be politically expedient for a member of the Joomla core team to be making money selling Mambo themes. Pride could also be a factor; In his shoes, there would be no way I would try and make money off a project I had previously turned my back on. This is all just my opinion of course. I just don't think it will happen.

I'm sure Andy would not be the first core developer to make money on something other than Joomla. This isn't a case of national security or even religion; where one could suffer in Hell for eternity for not being a member of the right denomination.

The simple fact is that right or wrong, users and developers will come and go from Joomla (their choice) and there will always be users of other CMSs as well. Mambo happens to be on a pretty big upswing right now and has proven that it has staying power and the ability to support a secondary market.

From a business standpoint, I think it makes perfect sense to offer Mambo friendly templates; for that matter how about versions for other CMSs too? So what if Andy is a Joomla core dev? I'm on the Mambo Steering Committee and the forum admin, but I still spend my days developing sites using Joomla! I work as a volunteer in the Mambo project and I happen to know that many of the people involved in the project have jobs that require them to work with other platforms besides Mambo. C'mon folks...this isn't war; it's not like we need to be worried about being tried for treason. :P It's software...they're templates...people buy them...the more people that buy them, the more money RT makes. If the people can't use them...they won't buy them. The solution seems pretty simple to me. ;)

      Then again...it's Andy's choice. 8)

    • Cant you just write your own commercial license to interact with joomlas license? i used to code modules and code templates for another php cms, and never had any problems with the gpl license of commercial releases. I think i have only ever glanced at the license when i have copied and pasted it as comments in my script files.
