Moo tools guru question

Ok so while I wait for the updated RokLatest to arrive I have been playing with the moo menu slider from the folks that made the fish eye menu.
The colormatic template is the bomb and it is the template I have been waiting for to do my dev site up correct.
Long story short.
I have everything close to where I want it to be with one little gotya. The slider menu works great in Firefox, but in IE the first time the page loads I get an error on page, and the slider will not work.
Hit refresh once and all the problems go away, loads good, slider works
Close the browser and come back and hour or two later and it does it again
What I have tried.
I changed the slider menu to use the same moo libraries as the template, no problems but no solutioneither
I tried changing the fire order of all the mambots that might cause a problem, still no solution
I tried changing the flash gallerie with RKslideshow, still no solution so I switched back
Any clues?

- I also noticed the tab for the control panel gets cut off behind your header when you open it.

yeah I am pretty much in early development.
That is a zindex issue with the slide show module and I have not discovered where to set that so it is below the 20 and 21 index that the tab is set for.
Still searching for the issues remaining
