Of course they are trying to protect the rights to their content, which I can understand, but I agree, it's a bit over the top.
(Much like the music industry suing people for 'casual downloads' of MP3 files, to the tune [pun intended] of 40 or 50K for downloading a couple of songs... )

If you are a developer, be sure to secure the rights to the images you provide for your clients.
If you are a customer, be sure your developer has done so...
I have always used copyright free images and have paid for them and agree with you. My wife is a professional photographer so I have always had an earful when it comes to copyright and images. That being said, I thought DCMA was put into place to handle these issues and it seems as though this just goes around that.
