    Talk about being ripped off....

Posted 15 years 10 months ago
    • A client of mine was so nice to show me a french company and their website:
      prographis.fr/home/

Try and compare it with mine - do you see some similarity?
      www.mintcreation.com

Normally I take it as a compliment, but damn it's annoying when it happens!

    • I had a "web designer" steal some of the content off of my site too. Send them a "cease and desist" letter (sample below), and prove that your site had the content up prior to theirs ( www.archive.org/web/web.php ). Threaten that if the site is not changed, you will take further legal action. What a blatant violation this was!

It has come to our attention that you have made an unauthorized use of our copyrighted work entitled (your website URL) (the "Work") in the preparation of a work derived therefrom. We have reserved all rights in the Work, first published in (date your site was live) as recorded in the Internet Archive [and have registered copyright therein]. Your work (their URL) on the (specific pages of violation) page(s) is essentially identical to the Work and clearly used the Work as its basis.
As you neither asked for nor received permission to use the Work as the basis for (their URL) nor to make or distribute copies, including electronic copies, of same, we believe you have willfully infringed my rights under 17 U.S.C. Section 101 et seq. and could be liable for statutory damages as high as $150,000 as set forth in Section 504(c)(2) therein.

We demand that you immediately cease the use and distribution of all infringing works derived from the Work, and all copies, including electronic copies, of same, that you deliver to us, if applicable, all unused, undistributed copies of same, or destroy such copies immediately and that you desist from this or any other infringement of our rights in the future. If we have not received an affirmative response from you by (date) indicating that you have fully complied with these requirements, we shall take further legal action against you including filing a notice of Digital Millenium Copyright Act (DMCA) infringement with search engines such as Google and others to have the offending site removed from their search results.

    • Thanks both!

Michelle my site is not to be found on the archive - probably because it is a subdomain?
