I did read the complete thread and acknowledge the answers you are talking about. At this particular moment I don't agree with the justifications given for templates being outside the restrictions of the GPL. Even though it is more of an issue to do with the actual terms of the GPL itself, I chose to raise the issue here, in context of the thread, so I can hopefully learn more and maybe even change my current stance .

Plus the template exemption is in the GPL itself, which predates Joomla.
I had the same concerns as you initially, but if you read the FAQ the Joomla guys laid out, it is explained througoughly and is fair.
- the php gode must be gpl, but the CSS, Java script and images do not, as they are obviously not a derivative work of Joomla. However the same should (and does I think) apply to other extensions anyway if they include css, JS and images.
Templates are highlighted because they are predominantly CSS etc and only a tiny bit PHP, whereas components are generally the opposite with the design being a small part of the component.

Yes, I think it's convenient for template designers that they are not bound by the GPL. Whether it's fair is another matter. That is why I can understand the reservations expressed by some 3PD's on the matter. You cannot forget that without Joomla! and extension developers there would be no demand for Joomla! templates. It's like a circle, you need all 3 components to make it complete.

I can understand why 3PDs have some distress over the template situation, but, like all things, it is dependant on how you interpret what has been said and if you agree/disagree with the lawyers.
From what I have read, the main "arguement" for templates being a "special" case is due to that they can operate outside of Joomla! as static pages where components cannot.
Also, the reference to CSS and images being "data" or whatever it is classed as as exempted from GPL. Does this still apply to CSS and images in components? Something I have not seen asked yet.
